Fourthwall, Inc. (“Fourthwall,” “we,” “our,” and/or “us”) values the privacy of individuals who use our website at https://www.fourthwall.com (our “Site”), as well as related websites and related services (collectively, our “Services”). This privacy policy (the “Privacy Policy”) explains how we collect, use, and share personal information from or about the users of our Services. If you are located in the European Economic Area (“EEA”), the United Kingdom, or Switzerland, “personal information” means any information relating to an identified or identifiable individual. The Privacy Policy applies to visitors of our Site; our customers (“Creators”) who use our Services to create online platforms (“Creator Sites”) to sell high quality branded products and show their fans love; and people who visit Creator Sites, make purchases or donations through them, or buy products from us directly, for example at orders.fourthwall.com (“End Users”).

When We Are the Seller. Fourthwall is the seller and merchant of record for products and memberships bought through Creator Sites, processes donations made through them, and sells some products directly to End Users. We are the controller of the personal information we process to complete those transactions (including payment, taxes, fulfillment and shipping, returns, refunds and withdrawals, fraud prevention, and customer support) and to operate, secure, and improve our Services and comply with the law, as described in this Privacy Policy. If you buy from a Creator Site or directly from us, our Merchandise Privacy Policy at fourthwall.com/legal/merchandise-privacy-policy explains how we handle your order information.

What Creators Are Responsible For. Each Creator runs its own Creator Site and is responsible for its content, for personal information it collects or receives (including the order and customer details we share with it, mailing lists, giveaways, and any apps, embeds, pixels, scripts, or integrations it adds), and for its own communications with End Users. Creators handle that information as independent controllers under their own privacy policies, and we are not responsible for their practices. To understand how any of our Creators process your personal information, please refer to that Creator’s privacy policy.

When We Act for Creators. For some features, such as hosting Creator Sites and the content Creators publish, providing Creators with analytics about visits to their Creator Sites, and sending messages Creators direct to End Users through our Services, we process personal information on the Creator’s behalf as its processor or service provider, under our agreement with that Creator (including any data processing agreement, which this Privacy Policy does not change). The Creator’s privacy policy governs that processing, and we will refer requests about it to the Creator. Our own use of Creator Site traffic for platform analytics is separate processing that we control.

Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service or, for purchases, the terms that apply to your order.

INFORMATION WE COLLECT

We may collect a variety of personal information from or about you or your devices from various sources, as described below.

A. Information You Provide to Us

Registration and Profile Information. If you sign up for an account, we ask you to create a username and password. We also ask you for your name, email address, date of birth, and other information.

Orders, Memberships, and Donations. When you buy products or memberships or make a donation through a Creator Site, or buy products directly from us, we collect your name, email address, shipping and billing address, phone number (if you provide it), and order details, and, for gifts, the recipient’s name and address. If you create an account, for example to access a membership, we also collect your login details.

Creator Payout and Tax Information. If you are a Creator, we collect the information we need to pay you and meet our legal obligations, such as payout account details, tax information, and, where required, identity verification information.

Payment Information. When you make payments to or through our Services, you may need to provide personal information, such as your credit card number and billing address, to our third-party payment providers, such as Stripe and PayPal, which handle it under their own privacy policies.

Communications. If you contact us directly, we may receive personal information about you. For example, when you contact us for more information about Fourthwall, we will receive your name or nickname, email address, channel URL, and the contents of your email. Messages sent to a Creator Site’s support email address go to our customer support team, which may forward messages intended for the Creator to that Creator. We send you service messages, such as order confirmations, shipping and membership updates, and responses to your requests, and, where permitted, marketing emails, which you can opt out of at any time. We also email you when a Creator sends you a message through our Services; the Creator is responsible for what it sends. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.

Reviews. If you leave a review about a product, including any photos, we collect this information.

Careers. If you decide to apply for a job with us, you may submit your contact information and your resume online. We will collect the personal information you choose to provide us as part of your job application, such as your contact information, education, and employment experience. If you apply for a job with us through a third-party platform (such as LinkedIn), we will collect the personal information you make available to us through such third-party platform.

B. Information We Collect When You Use Our Services

Location Information. When you use our Services, we may infer the general physical location of your device and the geographic regions our users come from. For example, your internet protocol (“IP”) address may indicate your general geographic region.

Device Information. We receive information about the device and software you use to download or access our Services, including IP address, web browser type, operating system name and version, and device identifiers.

Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our Services, like log files, performance logs, diagnostic reports, the pages or other content you view, the searches you conduct, and the dates, times, and durations of your use of our Services.

Information from Cookies and Similar Technologies. We and third-party partners collect information using cookies, pixel tags, or similar technologies. Our third-party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.

Cookies can also be used for functionality management, enabling us to make the user’s visit more efficient by, for example, remembering language preferences, passwords and log-in details. We may also use pixel tags and web beacons on our Services. These are tiny graphic images placed on web pages or in our emails that allow us to determine whether you have performed a specific action. Below is an overview of the types of cookies we and third parties may use to collect information.

• Strictly necessary cookies. Some cookies are strictly necessary to make our Services available to you. We cannot provide you with our Services without this type of cookies.
• Functional cookies. These are used to recognize you when you return to our Services. This enables us to adapt our content for you, and remember your preferences (for example, your choice of language or region).
• Analytical or Performance cookies. We also use cookies for website and app analytics purposes in order to operate, maintain and improve our Services.
• Advertising cookies. We and our advertising partners use these to show ads for our Services on other websites and apps and to measure how our ads perform.

Where required by applicable law, we obtain your consent to use cookies, and you can change your choices at any time through the cookie settings on our Services, where available. Please review your web browser’s “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete or choose not to accept cookies from our Services, you may not be able to utilize the features of our Services to their fullest potential. We do not respond to browser “Do Not Track” signals, but we do honor Global Privacy Control (see “U.S. State Privacy Rights”).

Creator Sites. Cookies, pixels, and similar tools that a Creator adds to or connects with its Creator Site, such as its own analytics, advertising, or email marketing tools, are the Creator’s responsibility and are governed by the Creator’s privacy policy.

C. Information We Receive from Third Parties

Partners. We may receive additional personal information about you from third parties such as data, marketing, payment, identity-verification, or fraud-prevention partners and combine it with other personal information we have about you.

Other Users. We may receive additional information about you from third parties, such as your End Users.

Apps. If you start an order in a third-party app or service that connects to our checkout, we receive the design and product choices you send us from that service and related technical information.

HOW WE USE THE INFORMATION WE COLLECT

We use the personal information we collect:

• To provide, maintain, improve, and enhance our Services;
• To process and fulfill orders, memberships, and donations, including payment, taxes, shipping, returns, refunds, and withdrawals, and to pay Creators;
• To communicate with you, provide you with updates and other information relating to our Services, provide information that you request, respond to comments and questions, and otherwise provide support;
• To market our Services, including through advertising on other websites and apps;
• To understand and analyze how you use our Services and develop new products, services, and features;
• To de-identify and aggregate information collected through our Services and use it for our business purposes;
• To find and prevent fraud, and respond to trust and safety issues that may arise, including notices about intellectual property or illegal content;
• For compliance purposes, including enforcing our Terms of Service and other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
• For other purposes for which we provide specific notice at the time the personal information is collected.

LEGAL BASES FOR PROCESSING EUROPEAN PERSONAL INFORMATION

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we only process your personal information when we have a valid “legal basis”, including when:

• Consent. You have consented to the use of your personal information, for example to submit your job application to our Services, or to use cookies.
• Contractual necessity. We need your personal information to provide you with the services you have requested, for example to process and deliver your order, provide a membership, pay Creators, or respond to your inquiries.
• Compliance with a legal obligation. We have a legal obligation to use your personal information, for example to comply with tax and accounting obligations.
• Legitimate interests. We or a third party have a legitimate interest in using your personal information. In particular, we have a legitimate interest in using your personal information for product development and internal analytics purposes, to prevent fraud, to market our Services, to share order and customer details with the relevant Creator, and otherwise to improve the safety, security, and performance of our Services. We only rely on our or a third party’s legitimate interests to process your personal information when these interests are not overridden by your rights and interests.

If you don’t provide personal information we need to perform a contract with you or to meet a legal obligation, we may be unable to provide the relevant Services.

HOW WE SHARE THE INFORMATION WE COLLECT

We may disclose personal information we collect from or about you as described below or otherwise disclosed to you at the time of collection.

Affiliates. We may share any personal information we receive with our affiliates for any of the purposes described in this Privacy Policy.

Vendors and Service Providers. We may share any personal information we receive with vendors and service providers retained in connection with the provision of our Services, such as payment processors, manufacturing, fulfillment, and shipping partners, hosting and content delivery providers, AI service providers (for example, for our in-product assistant and customer support), and customer support, email delivery, analytics, identity-verification, security, and tax and accounting providers.

Creators. When you create an account on a Creator Site, buy from it, become a member, make a donation, or send a message meant for a Creator, we share your account, order, and customer details, such as your name, contact details, and what you bought, with that Creator, which uses them as an independent controller under its own privacy policy. If a Creator connects third-party tools to its Creator Site, such as email marketing, analytics, or advertising tools, we send information about your visits and purchases to those tools at the Creator’s direction. If you submit a notice about content on a Creator Site, we may share it, including your contact details, with the Creator concerned.

Other Users. Creators are able to use our Services to create and develop online platforms and share content with other users. Any personal information that you voluntarily choose to include on or through our Services, including in a publicly accessible area of our Services (such as your online platform) or information you share with other users will be available to anyone who has access to that content. We are not responsible for other users’ use of available information, so you should carefully consider whether and what to post or how you identify yourself on our Services.

YouTube. We may share order details, without your contact details, so that YouTube can report sales.

Analytics. We use analytics services such as Google Analytics to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/ and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout. Advertising Partners. We work with third-party advertising partners to collect and process your information in order to show you ads that we think may interest you. Some of our advertising partners are members of the Digital Advertising Alliance (https://optout.aboutads.info) and serve ads through cookie-based technologies. Please visit their opt-out pages to learn about how you may opt out of receiving certain web-based personalized ads from member companies. These opt-outs will apply only to our third-party advertising partners that are members of these organizations. These opt-outs will not apply when our partners serve ads through non-cookie based technologies. You can access any settings offered by your mobile operating system to limit ad tracking, or you can install the AppChoices mobile app to learn more about how you may opt out of personalized ads in mobile apps.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your personal information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your personal information may occur if you post any objectionable content on or through our Services.

Merger, Sale, or Other Asset Transfers. We may disclose and transfer your personal information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our business or assets.

Consent. We may also disclose personal information from or about you or your devices with your permission.

YOUR RIGHTS AND CHOICES

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the additional rights described below.

• You may request access to the personal information we maintain about you, update and correct inaccuracies in your personal information, restrict or object to the processing of your personal information, have the personal information anonymized or deleted, as appropriate, or exercise your right to data portability to easily transfer your personal information to another company. In addition, you also have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work or where an incident takes place.
• You may withdraw any consent you previously provided to us regarding the processing of your personal information, at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent.
• You may object at any time to our use of your personal information for direct marketing.

You may exercise these rights by contacting us using the contact details at the end of this Privacy Policy. Before meeting your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain information for backups, archiving, prevention of fraud and abuse, satisfaction of legal obligations, or as otherwise permitted by law. We handle requests about processing we control, and we may refer requests about a Creator’s own use of your information, or about processing we do on a Creator’s behalf, to that Creator.

U.S. STATE PRIVACY RIGHTS

The disclosures in this section apply only to U.S. residents and are intended to supplement this Privacy Policy with information required by applicable U.S. state laws. The chart below provides the categories of personal information we have collected, disclosed to a service provider or a contractor for a business purpose, or sold or shared (for cross-context behavioral advertising purposes) in the preceding twelve months since this notice was last updated.

NOTICE OF FINANCIAL INCENTIVES

We may provide certain incentives, such as discounts for referrals. You can opt into the incentives by providing us with the information requested or as otherwise described in the Services. We collect personal information as described in the incentive, such as your email address. Your participation in any incentive is completely voluntary, and you have a right to withdraw from such incentive at any time. If you decide you don’t want to participate in an incentive, you can refrain from taking the requested actions.

The specific reward or incentive offered, if any, will be made available to you on the Services. The monetary value of the reward or incentive is a reasonable approximation of the monetary value of the personal information to us in connection with participating in the incentive. We arrived at this conclusion based on consideration of multiple factors, including the following: (1) the revenue we generate from referrals; and (2) the expenses we incur in operating the incentive program.

Depending on the jurisdiction in which you reside, you may have certain rights in relation to the personal information we hold about you. For example, you may have one or more of the following rights, in each case subject to limitations or exceptions as permitted or required by law:

• Right to Know. You have the right to access the personal information we hold about you and to receive a general account of our uses of that personal information. You may submit a verifiable request for information regarding: (1) categories of personal information collected, sold, shared, or disclosed by us; (2) purposes for which categories of personal information are collected, sold, or shared by us; (3) categories of sources from which we collect personal information; (4) categories of third parties to whom we disclosed, sold, or shared personal information; (5) categories of service providers or contractors to whom we disclosed personal information; (6) specific pieces of personal information we have collected about you including a copy of it in a portable format, and (7) in some states, a list of the specific third parties to which we have disclosed personal information.
• Right to Delete. You may submit a verifiable request that we delete certain information we have about you
• Right to Correct. You may submit a verifiable request that we correct inaccurate personal information that we maintain about you.
• Right to Opt Out. You may have the right to opt out of “sales” and “sharing” (for cross-context behavioral advertising) of your personal information, or its use for targeted advertising.
• Right to Limit Use and Disclosure of Sensitive Information. You may have the right to limit our use and disclosure of your sensitive personal information. We do not use or disclose sensitive personal information for purposes other than permitted under applicable law and as described in this Privacy Policy.
• Right of No Retaliation. You have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights.

Certain information may be exempt from such requests under applicable law. We need certain types of information so that we can provide the Services to you. If you ask us to delete such information, you may no longer be able to access or use the Services.

If you would like to exercise any of these rights, please submit a request to us at privacy@fourthwall.com. If we deny your request, you may appeal by replying to our decision. You will be required to verify your identity except for opt out requests. Before we fulfill your request, we may request additional information from you in order to do this. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us, unless your agent holds a valid power of attorney or for opt out requests.

In the past 12 months, we have collected the categories of personal information described in “Information We Collect,” which correspond to these categories under California law: identifiers; customer records and commercial information; internet or other electronic network activity information; approximate geolocation; audio or visual information (such as content you upload); professional or employment-related information (such as from job applicants); and sensitive personal information, namely account log-in credentials and, for Creators, tax and identity-verification information. We collect this information from the sources, use it for the purposes, and disclose it to the categories of recipients described above, and we keep it as described in “Retention.” We use sensitive personal information only for purposes that do not give rise to a right to limit its use.

We do not sell personal information for money. In the past 12 months, we have disclosed identifiers (including contact details, some of them hashed), commercial information (such as purchases and order totals), and internet or other electronic network activity information to advertising partners through advertising and analytics cookies and similar technologies, which may be a “sale” or “sharing” under some state laws. You can opt out using the “Your Privacy Choices” link on our Site, through the cookie settings on our Services where available, or by contacting us. We also treat a Global Privacy Control (GPC) signal from your browser as an opt-out for that browser and, if we know who you are, for you, and we process it in a frictionless manner (learn more at https://globalprivacycontrol.org). We do not knowingly sell or share the personal information of consumers under 16. California residents may also ask us about our disclosures of personal information to third parties, including Creators, for their own direct marketing by emailing privacy@fourthwall.com.

THIRD PARTIES

Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. The same applies to apps, embeds, scripts, and integrations that a Creator adds to its Creator Site. Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any personal information you disclose to these third parties. We encourage you to read their privacy policies before providing any personal information to them.

RETENTION

We take measures to delete your personal information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep this information for a longer period. When determining the specific retention period, we take into account various criteria, such as the type of service provided to you, the nature and length of our relationship with you, and mandatory retention periods provided by law and the statute of limitations.

SECURITY

We make reasonable efforts to protect your personal information by using physical and electronic safeguards designed to improve the security of the personal information we maintain. However, as no electronic transmission or storage of personal information can be entirely secure, we can make no guarantees as to the security or privacy of your personal information.

CHILDREN’S PRIVACY

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Services are directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at privacy@fourthwall.com.

INTERNATIONAL VISITORS

Our Services are hosted in the United States. If you choose to use our Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that your personal information will be processed outside of those regions, including in the United States. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests and orders (including to our manufacturing and fulfillment partners and to the Creator whose Creator Site you buy from), and operating our Services. Where we transfer personal information from the EEA, the United Kingdom, or Switzerland to a country that does not provide an adequate level of protection, we use appropriate safeguards, such as the European Commission’s Standard Contractual Clauses and their UK and Swiss equivalents, or rely on an exception permitted by law, such as where the transfer is necessary to perform our contract with you. CHANGES TO THIS PRIVACY POLICY

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through our Services, we will notify you through our Services, by email, or other means, and obtain your consent where required by law.
