Acceptable Use Policy

While Fourthwall believes in the free and open exchange of ideas and products, certain activities are expressly prohibited in order to create a better experience for creators and their fans. The following activities are forbidden:

1. Child exploitation. You may not use your Fourthwall site to offer goods/services or host content that either exploits or abuses children. This includes but is not limited to depictions of child abuse or the presentation of children in a sexual manner.
2. Illegal activities. You may not use your Fourthwall site to offer goods/services or host content that violates the laws of the jurisdictions in which you operate or do business.
3. Intellectual property. You may not use your Fourthwall site to offer goods or services, or post or upload Materials, that infringe on the copyright or trademarks of others.
4. Terrorist organizations. You may not use your Fourthwall site to offer goods/services or host content that support either the funding of or the membership in a terrorist organization, violent extremist group, hate group, criminal organization, or armed militia in conflict. Documentary, educational, journalistic, and counter-extremism content about these groups is permitted, provided it does not promote, glorify, fundraise, or recruit for them and does not sell their symbols or merchandise.
5. Self-harm. You may not use your Fourthwall site to offer goods/services or host content that promotes self-harm, suicide, disordered eating, or dangerous challenges. Educational, awareness, and recovery-support content is permitted; this rule targets promotion, not discussion.
6. Hateful content. You may not use your Fourthwall site to offer goods/services or host content that promotes hate or violence against people based on race, ethnicity, color, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status, or other forms of discriminatory intolerance.
7. Harassment, abuse, defamation, bullying, and threats. You may not use Fourthwall to offer goods/services, or upload content, that harasses, abuses, defames, bullies or threatens a specific individual, or incites others to do so. This includes swatting: making false emergency reports intended to direct an armed police response to a person's location.
8. Personal, confidential, and protected information. You may not use your Fourthwall site to offer goods/services or host content that contains personally identifiable information, sensitive personal information, sensitive health information, or confidential information (credit card numbers, confidential national ID numbers, or account passwords) unless you have express written consent from the person to whom the information belongs or are otherwise authorized. This includes doxxing: publishing a person's home address, private phone number, private contact details, or other information that could be used to locate them, without their consent.
9. Violent and graphic content. You may not use your Fourthwall site to offer goods/services or host content that glorifies real violence or suffering, including graphic gore and real or hyperrealistic depictions glorifying violence. Fictional, animated, or artistic violence that does not glorify real suffering, such as horror art, game content, or animated fight scenes, is permitted.
10. Adult content and services. Fourthwall’s payment processors will not process payments for adult goods or services. You therefore may not use your Fourthwall site to offer goods/services or host content that (i) contains pornography or other mature audience content that depicts nudity or explicit sexual acts, or (ii) relates in any way to adult services, including without limitation prostitution, escort services, pay-per view pornography, sexual massages, or adult live chat features. This prohibition includes AI-generated sexual content and deepfakes: hyperrealistic sexual depictions of real people without their explicit consent.
11. Deepfakes. You may not use your Fourthwall site to offer goods or services, or post or upload materials that include deepfakes, meaning AI-generated depictions that make a real person appear to say or do something they did not.
12. Third-party access and license resale. You may not sell, share, or resell access to third-party products or services you are not authorized to distribute, including subscription or account credentials, software license keys, game keys or accounts, IPTV or streaming access, and paid content authored by others.
13. Resale of contact lists. Selling or distributing vendor lists, contact lists, or similar data-based digital products is not permitted.
14. Service-based products. Services such as IPTV, SEO or growth services, consulting, car rental, and other service-based offerings are not permitted on your Fourthwall site.
15. Malicious software and fraud-enablement products. You may not sell or distribute malware, exploits, phishing kits, stolen-data access, hacking tools or services for unauthorized access, or instructional content whose primary purpose is enabling unauthorized access, payment fraud, or account takeover (carding tutorials, bypass guides, hacking courses). Legitimate security education is not automatically banned; contact support before launching it.
16. Hazardous, regulated, and freight-only goods. You may not sell products that cannot lawfully or practically be delivered through standard parcel shipping: hazardous materials such as compressed gases, refrigerants, fuels, and corrosive or flammable chemicals; goods whose sale or purchase requires a government license or certification (for example, refrigerants restricted to certified technicians); perishables requiring cold-chain handling; and freight-only items such as large appliances or vehicles.
17. Weapons and Firearms. Creators may not use the Fourthwall platform to sell, promote, or distribute weapons or weapon-related products. This includes firearms, firearm parts or components, ammunition, explosives, and similar regulated weapons or accessories. Due to payment processor restrictions and regulatory compliance requirements, such products are not permitted on the platform. This does not prohibit apparel or merchandise that depicts weapons imagery.
18. Cannabis, CBD, and drug paraphernalia. You may not use your Fourthwall site to sell cannabis, marijuana, hemp, CBD, THC, or other cannabinoid-containing products, or paraphernalia designed for use with cannabis or other controlled substances, regardless of the legal status of such products in your jurisdiction. This does not prohibit apparel or merchandise that depicts cannabis imagery.
19. Tobacco, nicotine, and vaping products. You may not use your Fourthwall site to sell tobacco or nicotine products, including cigarettes, cigars, smokeless tobacco, e-cigarettes and vaping devices, e-liquids, heated tobacco products, nicotine pouches, or accessories designed primarily for smoking or vaporizing tobacco or nicotine. This does not prohibit apparel or merchandise that depicts tobacco or tobacco-related product imagery.
20. Pharmaceuticals, medical devices, and unverified health products. You may not use your Fourthwall site to sell prescription medications or other pharmaceuticals, regulated medical devices, or supplements, nutraceuticals, and other products marketed with health claims that have not been verified by a competent regulatory body. This does not prohibit apparel or merchandise that depicts medical or pharmaceutical imagery.
21. Alcohol. You may not use your Fourthwall site to sell alcoholic beverages or other products containing alcohol intended for consumption. This does not prohibit apparel or merchandise that depicts alcohol imagery.
22. Digital currencies, gift cards, and stores of value. You may not use your Fourthwall site to sell, trade, or promote the sale of cryptocurrencies, digital currencies, in-game currencies, or gift cards. This includes NFTs, tokens, and any stored-value product such as points, credits, or top-ups that can be monetized, resold, or redeemed for goods, services, or cash. This does not prohibit Fourthwall gift cards created through your Fourthwall dashboard, which can be redeemed only on your own Fourthwall site.
23. Off-platform content and fulfillment (digital). Digital products and entitlements must be delivered through Fourthwall, via Fourthwall's file delivery, via a Fourthwall-integrated app, or a Fourthwall-integrated fulfillment partner. Using Fourthwall solely as a payment processor, checkout page, or webhook trigger for content that is hosted, sold, and delivered entirely outside Fourthwall is prohibited. Arranging or completing off-platform delivery of a product listed on Fourthwall in order to avoid Fourthwall's fees or policies is itself a violation. If your delivery setup does not fit these paths, contact support for approval before launching.
24. Financial products and services. You may not use your Fourthwall site to offer financial products or services, including lending, investment or brokerage services, money transmission or currency exchange, check cashing, debt relief or settlement, credit repair, or identity-theft protection services. These categories are prohibited or restricted by our payment processors and are not available on the platform.
25. Donations and tips. Donations and tips must be voluntary. They may not be a condition of, or payment for, any product, content, access, or service. Selling anything through the donations feature is prohibited.
26. Paid-entry competitions and prize schemes. Selling entry into any competition with a monetary or material prize is prohibited, whether the outcome is determined by chance or by skill. This includes raffles, lotteries, ticketed prize draws, buy-in contests, paid tournament entries, and bidding-fee or penny auctions. Promotional giveaways are permitted, provided that: (a) entry is free and no purchase is required to enter or win; (b) if a purchase grants bonus entries, a free entry method with equal chances is available and clearly disclosed; and (c) the creator publishes official rules and complies with all applicable laws in the United States and in every jurisdiction where entry is offered.
27. Charity fundraising and crowdfunding. You may not run charity raffles, crowdfunding campaigns, or charity fundraisers through your Fourthwall site except through Fourthwall-supported charity features, official Fourthwall apps and integrations built for charitable giving (for example, Pledge or Tiltify), or with Fourthwall's prior written approval. Contact support before launching a charity campaign that does not use one of these options.

Fourthwall has the right, but not the obligation, to monitor or investigate compliance with respect to this Acceptable Use Policy. Fourthwall may, at any time and without notice, suspend or terminate your account if you engage in activities that violate either the letter or the spirit of this policy. Our determination of whether a violation of this Acceptable Use Policy has occurred will be final and binding. Any action or inaction taken with respect to enforcing this Acceptable Use Policy will be at our sole discretion.

Fourthwall can modify this policy at any time by posting a timestamped update. By continuing to use Fourthwall after a revised version of the Acceptable Use Policy has been posted, you agree to comply with the latest version.
